Construction & Site Water Management: A UK Compliance Guide

Construction and demolition sites generate regulated water streams — dewatering flows, surface water runoff, contaminated groundwater and process effluent — that cannot lawfully be discharged untreated. This pillar explains which permit applies to each route, how to design a treatment train that meets the limits, and what you must monitor and record.

What water streams does a construction site produce?

A working site is a water treatment plant that nobody planned. Excavation below the water table produces dewatering flows that pick up silt, cementitious leachate and hydrocarbons on their way to the sump. Stripping vegetation and topsoil turns the site into a near-impermeable surface, so rainfall becomes surface water runoff carrying suspended solids at concentrations one to two orders of magnitude above any discharge limit. Where the land has a contaminative history, pumping mobilises contaminated groundwater — solvents, metals, fuel residues. Welfare facilities need a temporary potable supply that is fit to drink. Demolition, cutting and washdown produce process effluent loaded with alkalinity, fines and oil.

Each of these is a separate regulated activity with its own permit, its own limits and its own monitoring duty. The volume pumped is not the trigger — the quality of the water after it has touched the site is.

Which permit applies to which discharge route?

Three discharge routes exist in England and Wales, each with a distinct permitting path under the Environmental Permitting (England and Wales) Regulations 2016. Scotland operates the parallel CAR regime through SEPA.

The binding constraint: for discharge to a watercourse, suspended solids at 30 mg/L is what most sites fail on. Raw dewatering water from clay or silty ground routinely exceeds 5,000 mg/L. A treatment train is not optional.

Getting the route wrong is expensive. Discharging untreated water to a watercourse is an offence under s. 85 of the Water Resources Act 1991, with unlimited fines in the Crown Court.

Construction water sits at the junction of two other pillars. The permits, consent limits and monitoring duties are the same statutory machinery covered in water quality and compliance — trade effluent consents, discharge standards and the metals limits that apply whatever the source of the water.

The plant that does the work is the same plant used everywhere else: clarifiers, dissolved air flotation, dosing skids, filters and separators. Those are covered in water treatment equipment. What changes on a construction site is that the duty is temporary, the influent is far more variable, and the kit usually arrives on a lorry.

Frequently asked questions

Do I need a permit to pump water off a construction site?

Almost always. If you discharge anything other than genuinely clean, uncontaminated rainwater to a watercourse or sewer, you need a permit or a trade effluent consent. Discharge to ground always requires a groundwater activity permit. The trigger is water quality, not the volume you pump.

Does the approved SuDS scheme cover construction-phase drainage?

No. The Environment Agency treats construction-phase discharge as a separate activity from the permanent drainage system approved by the SuDS Approval Body. Temporary drainage installed after topsoil strip needs its own permit, or the water must be captured and treated before it leaves the site.

Is concrete washout water hazardous waste?

Water above pH 12 or below pH 2 is classified as corrosive hazardous waste under the Waste Framework Directive (List of Waste code 16 03 03*). It cannot go to sewer or watercourse without neutralisation, and must be treated on site or removed by a licensed waste carrier.

Can I hire a treatment plant rather than build one?

Yes — containerised coagulation, flotation and filtration plant is routinely hired for short-term duties. It needs exactly the same permit as fixed plant, and the application must include the plant specification, chemical storage arrangements and emergency shutdown procedure. Mobile plant still has to meet the same emission limits.
